Greenhouse Auditor of Accounts Office of Auditor of Accounts Townsend Building Dover, Delaware 19901 RE: Designation of Temporary/Seasonal Employee or Employee of Temporary Employment Service as Ex Officio Member of Malpractice Review Panel Opinion No. 85-1001 Dear Dennis: You have asked two questions: whether a temporary/ seasonal employee of the Insurance Department (the Department) is eligible to be designated as the ex officio member of a malpractice review panel under 18 Del. C. §6804(b), and whether an individual employed by a temporary employment agency and working in the Department under a contract between the Depart- ment and the employment agency is eligible under the same statute. We conclude that a temporary/seasonal employee may serve legally as the ex officio panel member under 18 Del. C. §6804(b), but that an employee of an employment service may not. Eighteen Del.
