May division directors appoint exempt personnel pursuant
to 29 Del. C. §5903(5)?
Division directors who are heads of state agencies for
purposes of 29 Del. C. 95903(4) may appoint exempt per-
sonnel pursuant to 29 Del. C. §5903(5).

DISCUSSION:
You have asked the opinion of this Office whether a divi-
sion director is entitled, as the head of a State Agency, to appoint a prin-
cipal assistant or deputy and a private secretary outside of the classified
system. For the reason stated below it is our opinion that division directors
who are heads of State Agencies may appoint such personnel.
Twenty-nine Delaware Code §5903(5) excludes from the
classified service:

(0] ne principal assistant or deputy and
one private secretary for each head of
a State Agency. ...
