Dear Mr. Valdez:
This letter will acknowledge receipt of the above referenced
rules and regulations adopted by the Board of Social Services
at the December 4, 198l meeting.
These rules replace the emergency rules concerning readoption
of medical assistance rules concerning standards for denial
and termination of vendor participation which were adopted
October 1 1981. These emergency rules were made permanent
pursuant to C.R.S. 1973, 24-4-103(6) at the December 4,
1981 meeting of the Board of Social Services.
Pursuant to the Administrative Procedure Act, particularly
C.R.S. 1973, 24-4-103(8)(D), this office has reviewed the
rules and finds them to be within the authority of the Board
of Social Services to promulgate and, further, that there
are no apparent constitutional or statutory deficiencies in
their form or substance.
The authority for the Board of Social Services to adopt the
readoption of medical assistance rules concerning standards
for denial and termination of vendor participation lies
in: 42 U.S.C. 1396a(a)(13); 42 C.F.R. 431.151-*154; 42
