SUBJECT: APPROVAL OF PETITION FOR TRANSFER OF TERRITORY
FROM ONE SCHOOL DISTRICT TO ANOTHER-FILING OF WRIT-
TEN OPPOSITION TO TRANSFER-Under discussion is the application of
Education Code section 2371, as amended in 1974 and as it read prior to its
1974 amendment, regarding procedures for approving a petition for the
transfer of inhabited school district territory from one district to another,
where the district of origin has filed written opposition to the transfer. Section
2371 prior to its 1974 amendment applies to approval of a petition for transfer,
where written opposition is filed before the effective date of the amendment.
Section 2371 as amended in 1974 applies to approval of a petition, where
written opposition is filed after the effective date of the amendment.

The Honorable Keith C. Sorenson, District Attorney of San Mateo County,
and The Honorable Richard A. Robyn, County Counsel of Calaveras County, have
independently requested an opinion on a question that concerns the effect of amend-
ments to section 2371 of the Education Code. Effective January 1, 1975, section
2371 changed the procedures required to approve a petition for the transfer of
inhabited school district territory from one district to another, where the district
of origin has filed written opposition to the transfer. The question may be stated as
follows:
