Kirby, Director of the Department of Alcoholic Beverage Control, has requested an opinion on the following question: Whether a violation of section 25503, subdivision (d) of the Alcoholic Bever- age Control Act occurs when a distilled spirits wholesaler maintains a wallboard sign in the union hall of the bartender's union and pays $100 per month for the privilege. The conclusion is: A violation of section 25503, subdivision (d) of the Alcoholic Beverage Control Act occurs when a distilled spirits wholesaler pays $100 per month for the privilege of maintaining a wallboard sign in a union hall of a bartender's union, and the sum is paid to the union to encourage and promote the sale of alcoholic beverages sold by the wholesaler.
