Udall Pima County Attorney Courthouse Tucson, Arizona RES Deputy Rogistration Officers QUESTIONS: (1) Can the county recorder appoint or commission deputy registration officers without the recommendation of the county chairman of the various political parties and, further, can the county recorder appoint deputy recorders to register qualified electors? (2) If no political party submits names for appointment, may the county recorder appoint deputy registration officers without precinct qualifications? Article XII, Section 3, of the Arizona Constitution created the office of county recorder. The Constitution also in Article XII, Section 4, mandated the legislature to create the powers and duties of this office. Pursuant to this constitutional provision, the legislature in 1953 enacted Section 55-202, A.C.A. 1939, as amended, giving the county recorder the power and duty to register qualified elec- tors. This statute reads as follows 55-202. Registration by county recorder and justices f -th p e naT -rte uary :7T93QTand continuously thereafter, the county recorder of each county shall register WiThout chargo and in accordance with the provisions of this 1rticle any qualified elector who presents hirself for such purpose.
