Dear Mrs. Frohmiller:
We have your letter of December 6, wherein you state:
Will you please give me your opinion as to whether
or not enclosed claim j#2305 presented by James T.
Griffie in the amount of y449.50 for the purpose
of fertilizer, Australian Rye Seed, Bermuda Seed
and labor in breaking soil, grading, seeding, and
fertilizing of ground for lawn is an expenditure
for a public purpose within the authority of the
appropriation of the State Board of Social Security
and Welfare - Crippled Children Service.
The claim mentioned in your letter appears to be regular
in form, duly verified by the claimant, and is approved by the
State Board of Social Security and Welfare, and appears to be an
expenditure for planting a law'm at the hospital or convalescent
home for crippled children, maintained by the State Board of
Social Security and Public Welfare.
Section 70-107, Code of 1939, provides in part as follows:
The State Department shall be charged with the admin-
istration of the welfare activities of the State as
hereinafter provided. The State Department shall:
'(a) Administer all forms of public assistance, in-
cluding * * * service to crippled children;
3(c) Establish and administer a program of service
for children who are crippled or aho are suffer'ng
from conditions which lead to crippling, which shall
provide for developing, extending, and improving
services for locating such children, and for provid-
ing for medical, surgical, corrective, and other
services and care, and facilities for diagnosis,
hospitalization, and aftercare; supervise the admin-
istration of those services included in the program
