1940 Arizona Attorney General Reports and Opinions 1 (1940)

handle is hein.sag/sagaz0061 and id is 1 raw text is: January 2, 1940.

Town of Holbrook,
Holbrook, Arizona.
Attention: Mr. Geo. A. Keyes, Town Clerk.
Dear Sir:
We have your letter of December 20th desiring
to know whether or not the Town of Holbrook has the
right to condemn real property when the same is de-
sired as a location for the construction of a tovm
building, fire station, etc.
It is our opinion that the Town of Holbrook
has such power. Section 373, R. C. A. 1928, gives
to towns the right to erect the necessary public
buildings. SectioM 1329, . C. A. 1923, gives mur
icipalities the right to condemn buildinzs and
grounds for public use.
We trust this is a sufficient answer to
your inquiry.
Yours very truly,
JOE CONWAY,
Attorney General.
EDWARD P. CLINE,
Assistant Attorney-General.
EARL ANDERSON,
Special Aaistant
Attorney General.
