Dear Superintendent Harris:
This is in reply to your letter in which it is stated:
Would you please render a legal decision for the
Board of Education of the Swifton Special School
District # 33 of Jackson County.
For the past several years, the campus of the
Swifton Schools has been open and the students
were allowed to go uptown for lunch at the dinner
hour. This year, the Superintendent and Board
decided this was not in the best interests of the
students-safety wise. With this in mind, the
Board of Education adopted a policy of closing
the campus and not allowing the students to leave
the campus. Now, this is the problem, just across
the street in front of the school an elderly lady
has a small store that she has operated for the
past'sixteen years. Almost all of the school
patrons are in favor of not allowing the students
to go up town during the lunch hour, but almost
all of them want the Board to make an exception
in her place and allow the students to go to this
store during school hours.
To add further to this, neither the Board or Admin-
istrative staff see any danger to the students going
to and from this store as it is just across the
street from the High School.
Now, the decision we would like from you is; Does
the school board have the authority to amend its
closed campus policy to allow the students to go
