Dear Mr. Watson:
In your recent letter of December 6, 1967, you requested
an opinion from this office on the following:
What would be the legal procedure to
take in controlling hogs which are running
loose? Would one be allowed to shoct
these hogs and still be within the law?
What is a lawful cattle fence?
What would be the sheriff's duty in
enforcing the hog law, and what would
be the proper procedure to take?
Please be advised of Ark. Stat. Ann. § 41-434 which provides
that it shall be unlawful for the owner of any hogs or swine
to permit the same to run-at-large in this state. The penalty
for violation of this statute is contained in Ark. Stat. Ann.
§ 41-435 which states: The owner of any hogs or swine violating
the provisions of this Act [41-434 -- 41-435] shall be liable
for any damages resulting from such violation, and shall be
guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum of less than fifty dollars ($50.00) nor more than
two hundred dollars ($200.00).  The prosecuting attorney of
your district, has the duty of taking the proper action as
provided by law.
