EXPLANATORY AND FINANCIAL MEMORANDUM The Bill provides for the imposition of limits on aircraft move- ments at designated aerodromes ; amends the Civil Aviation Act 1982 ( the 1982 Act ) to make further provision for securing the most effective use of aerodromes ; and makes provision for reducing the indebtedness of the Civil Aviation Authority to the Secretary of State. Clause 1 empowers the Secretary of State to impose a limit or limits on the number of aircraft movements at aerodromes owned by the British Airports Authority and designated by the Secretary of State for that purpose, and imposes a duty on the BAA to secure that any such limit is complied with. It adds to the Secretary of State's power to direct the CAA under section 6(2) of the 1982 Act a power to give a direction in order to facili- tate compliance with any such limit. It also provides for cir- cumstances in which the CAA is under a duty to consider exer- cising its powers to revoke, vary or suspend air transport licences in order to prevent or reduce excess demand for the use of a designated aerodrome subject to any such limit. Clause 2 provides for the BAA to prepare and implement, sub- ject to the approval of the Secretary of State, either a scheme for the allocation (by sale or otherwise) of rights to perform move- ments at a designated aerodrome which are to be taken into account for the purposes of any limit imposed by virtue of clause 1 or a scheme for the payment of special charges at a designated aerodrome to which such a limit applies. The Secretary of State is given power to direct the BAA to prepare a scheme under the section or to revoke such a scheme. Clause 3 inserts an additional ground on which the Secretary of State may give directions to the CAA under section 6(2) of the 1982 Act, namely in order to secure the most effective use of aerodromes within the United Kingdom. Clause 4 substitutes a new subsection for section 68(1) of the 1982 Act so as to require the CAA in exercising its air transport licensing functions to exercise them in the manner best calcula- ted to secure the most effective use of aerodromes and to facili- tate compliance with any limits imposed by virtue of clause 1.
