Introduction to the Special Issue on Forensic
Mental Health Consulting in Family Law: Part
of the Problem or Part of the Solution?

This special issue of the Joumal of Child Custody is devoted to the
exploration of emerging and evolving mental health consulting in family
law. Certainly over the last five to ten years, it has become apparent that for-
ensic mental health professionals (FMHPs) have been involving themselves
in custody cases in ways that are moving afield from their historically
traditional functions as court-appointed or private mediators, or neutral,
court-appointed custody evaluators. During this period of time, many of us
have seen changes in the family law landscape. Despite the fact that the
courts are more and more crowded and under-resourced, litigation has
become increasingly intense and contentious. The recent economic down-
turn has only amplified challenges for divorcing families.
At the same time, there has been a veritable explosion of well-
grounded, scientifically rooted research into some of the thorniest issues
we see in custody cases. While definitive answers remain elusive, we now
have deeper understanding of important issues such as alienation, and have
better models and procedures for assessing abuse and domestic violence
allegations and relocation cases, to name a few. At no time has it been more
important for custody evaluators and others working in family law to keep
abreast of the emerging literature.
It is heartening to see that at the same time that we are looking to
broaden and refine our knowledge base and clinical skills, FMHPs are also
engaged in examining how we go about our professional work. Within the
past decade, we have seen a revision to the APA Guidelines for Child
