Abstract: Starting from the link, identified by the Spanish legislator, between the
insolvency reform de mecanismo de segunda oportunidad, Rdl 1/2015, de 27 de febrero
y Ley 25/2015, de 28 de julio, about the beneficio de exoneracion del pasivo insatisfecho,
and Ley 3a, Titulo XV, Partida V, Ley de las Siete Partidas, the paper aims to show the
Romanistic foundations of this legislation and the pivotal role of Alfonso X in the
historical implementation of a more humane treatment for honest insolvent debtors.
Key-words: second chance; discharge; exploitation; disbursement; sale of assets.
Sommario: Prendendo spunto dal legame, esplicitamente identificato dal legislatore
spagnolo, tra la reforma concursal de mecanismo de segunda oportunidad, Rdl 1/2015,
de 27 de febrero y Ley 25/2015, de 28 de julio, sul beneficio de exoneracion del pasivo
insatisfecho e la Ley 3a, Titulo XV, Partida V, della Ley de las Siete Partidas, l'articolo
ha lo scopo di mostrare il fondamento romanistico di questa legislazione e il cruciale
ruolo di Alfonso X nell'affermazione storica di un pil umano trattamento del 'debitore
meritevole'.
Parole-chiave: seconda opportunity; esdebitazione; remissione; liberazione dai debiti;
cessione dei beni.
1. LE RADICI STORICHE DELL'ADOZIONE DELLA POLITICA DELLA SECONDA
OPPORTUNITA: ITALIA E SPAGNA A CONFRONTO
Come e noto, le numerose, recenti crisi economiche, succedutesi a partire dalla
seconda meta degli anni Duemila, hanno reso un nuovo approccio alla regolazione
dell'insolvenza una priorita in tutti i Paesi europeil. E, questo nuovo approccio, oggi, in
