PUBLIC POLICY AS A REFUSAL GROUND: WELL REGULATED?
The Brussels Convention wants to promote the free circulation of
judgements within the EU, and therefore the refusal grounds for
recognition and enforcement are kept limited to the ones art. 27 and
art. 28 enumerate. The Brussels Convention only withheld the
violation of public policy, as reason for refusal. In this article Ms.
de Roover makes a Qualitative investigation of 43 judgements
about this public policy argument as a refusal ground.
