A Major Success -ABA House
Passes Federal Distributive Funding Policy

new policy to encourage the federal government to
make annual appropriations of federal distributive
funding to state and local governments passed the
House of Delegates in August. This is a major achievement
for the Section of State and Local Government Law, which
sponsored Recommendation 105.
The ABA House of Delegates (HOD) met during the
concluding days of the ABA Annual Meeting in Chicago
and took action on a number of interesting, timely, and
sometimes controversial proposals. Recommendation 105
was brought before the House on Monday morning,
August 3, by a working group that included Section
Delegates Patty Salkin and Ben Griffith, Oregon Court
of Appeals Judge Ellen Rosenblum, Finance Committee
Chair Ken Bond, and ABA Young Lawyers Division (ABA
YLD) Delegate Danny Van Horn. Following brief debate
and presentations by the working group and one opponent,

also an ABA YLD Delegate, the House of Delegates passed
R.105 by a clear and unambiguous voice vote, and our
Section's proposal became official ABA policy.
The Early Stages of the Recession
Our nation was sliding into the depths of what many would
come to call the Great Recession. The election of Barack
Obama was still several months away, and our Section leader-
ship was holding an executive committee meeting at Seyfarth
Shaw's offices in Chicago in conjunction with the Annual
SOC Leadership Meeting on September 21,2008.
Ken Bond, chair of the Section's Finance Committee,
had put the final touches on a recommendation regarding
federal revenue sharing. In that early draft of what would
ultimately be introduced as R. 105, Bond traced the histori-
cal development of transfers of funds from the federal gov-
