COURT DECISIONS ORDINANCE TAXING VESSELS.-The opinion of the Supreme Court of the United States, by HARLAN, J., in two cases, holding that an ordinance of a city, requiring all boats land- ing at such city to pay a wharfage, the city being riparian owner of the river front where landing was made, and having erected and maintained at its own cost improved wharves for the beflefit of those engaged in commerce, is not in violation of the consti- tutional prohibition against States regulating commerce, or laying tonnage duties. BONDS IN AID OF RAILROADs.-The opin- ion of the Supreme Court of the United States by HARLAN, J., holding, that the consolidation of a railroad company, having a subscription from a municipal corporation in aid of the construction of its road, with another company, does invalidate such sub- scription; the consolidated company, succeeds to the rights and franchises of the former company. PRACTICE CASES.-Several short practice cases of the Supreme Court of this State. The publicaton of the rulings of the Supeme Court upon questions of practie make the members of the bar familiar with the practice, and prevents them from occupying the time of the court in making motions on questions that have been settled by the court. PRACTICE-APPEAL-POWER OF COURT OVER LOWER COURT CLERK.-The opinion of the Supreme Court of Calafornia, by McKEE, J., holding that for all purposes connected with its appellate jurisdiction, the Supreme Court has the same power over the clerk of the court below as it has over its own clerk. PARTNERSHIP-DEATH OF PARTNER.-The opinion of the Appellate Court, First District, by WILSON, J., holding that on the death of one of a firm, the surviving partners stand in the relation of trustees to the partnership estate; that although executors have absolute power of disposal of the personal effects of their testator, an exception exists in the case of a purchase by one standing in a relation of trust or confidence with respect to the sub- ject-matter of the sale; in such case the pur- chaser of such personal property takes the legal title charged with the liability to be set aside at the instance of the cestui que trust if he makes his application in a reason- able time, and in such case it is immaterial whether the sale was a beneficial one or not; that in the absence of an agreement therefor, a partner is not permitted to charge for his personal services in attending to the partner- ship business.
