handle is hein.journals/redes12 and id is 1 raw text is: O conceito de Segurança Jurídica problematizado: contribuições da linguística e do anarquismo epistemológico Rafael Sarto Muller Pontifícia Universidade Católica de Minas Gerais http://orcid.org/0000-0002-7651-9023 Resumo: O presente artigo pretendeu empreender uma análise linguística dos conceitos de Segurança Jurídica, refletindo-os dentro de uma problemática decisória à luz do Anarquismo Epistemológico de Feyerabend. Identificaram-se dois grupos principais de noções para as quais se podem direcionar a opção de conceituação: uma positivista, cujo significado reside na padronização e normatividade da lei; outra neoconstitucionalista ou novo-paradigmática, cujo significado decorre da opção principiológica da confiança no Estado e sua não- perversidade. Trazida para dentro do processo decisório, as contribuições linguísticas apontam para que a interpretação seja feita: a) usando-se da linguagem comum ao máximo que possível; b) descrevendo ao máximo os contextos de produção e veiculação da mensagem; c) sendo redundante, dispondo o mesmo conteúdo da mensagem sob diversas formas. Já pela perspectiva anarcoepistemológica, delineia-se uma nova ética que observa: a) como a Idealista, os valores da proposição de contexto ideal desejado; b) como a realista-consequencialista, as condições e conflitos reais do momento da decisão; c) diferentemente deste última, preocupa-se especialmente com os efeitos sobre a estrutura, metacomunicando-os, e as oportunidades de subverter o status quo, assumindo como externalidade positiva a desestabilização imediata desde que voltada a uma intervenção e mudança em direção ao ideal. The concept of Legal Certainty problematized: contributions of linguistics and epistemological anarchism Abstract: This article intended to undertake a linguistic analysis of the concepts of Legal Certainty, reflecting them within a decisive problematic in the light of Feyerabend's Epistemological Anarchism.
