IIplaide en conclusion pour une conception civiliste de l'autoriti du pr&dent, mMle de respect et de sens critique, subordonnie au droit commun lIgislatif et aux droits de la raison. Unity, continuity and a search for novel solutions are the hallmarks of the recent reform of the Civil Code. From this triple perspective and basing himself on the Preliminary Provision of the Civil Code, the general transitional provisions of the <<Act Respecting the Implementation of the Civil Code>>, the amendments to the <<Interpretation Act>> and the civilian tradition of interpreta- tion, the author suggests a principled approach to interpretation, not only of the new code, but of all legislation dealing with civil law. He concludes with a plea in favour of a civilian conception of the authority of precedent, incorporating both respect and critical judgment, which subordinates judicial authority to that of the <jus commune>> expressed in the written law and to the dictates of reason.
