In 1998, Congress extended the term of copyright protection
for all works by 20 years. The Supreme Court is asked to
determine whether this extension goes beyond the power
granted to Congress in the copyright and patents clause
of the Constitution and whether it violates the
First Amendment. The case is important because of what it
will say about the Court's view of the constitutional limits
on congressional power and because it could remove
copyright protection from a large number of works
that are currently protected.
MILLER-EL V. COCKRELL
Thomas Joe Miller-El contends that prosecutors engaged
in unconstitutional racial discrimination in the course
of selecting the jury for his murder trial. He has introduced
evidence that, among other things, the manuals used
in the Dallas prosecutor's office for many years explicitly
called for challenging racial minorities to keep them
off juries. Now Miller-El asserts that when it refused
to consider his appeal from the denial of his petition
for habeas corpus, the federal appellate court improperly
applied existing precedent forbidding racial discrimination
in the exercise of peremptory challenges and incorrectly
interpreted federal law.
