  Happy  New   Year!
  Welcome  to the first issue of Pratt'journal ofBankruptcy Law for 2018! This
issue begins with an article discussing oil company bankruptcies. We also have
articles covering a U.S. Court of Appeals for the Second Circuit ruling allowing
efficient market interest rates for cramdown loans, Bankruptcy Code Section
503(b)(9) and e-commerce, insolvency reform in Brazil, a new legal regime for
security agents in debt financings in France, and a U.S. Supreme Court decision
on international service of process by mail.
Liability in Oil Company  Bankruptcies
  The  recent commodity downturn  caused many  oil and gas operators to file
for Chapter  11  to shed excess debt  and liabilities built up during the
commodity  boom,  but few operators affirmatively sought to abandon wells as
part of the reorganization or sale process. However, there were examples where
the dire economic situation forced an exploration and production company to
seek to jettison go-forward obligations associated with decommissioning or
plugging and abandoning  unproductive wells in order to sell its economically
viable assets or to provide a definitive conclusion to its Chapter 11 case. In our
