Ghana's jury crisis: implications for constitutional
human rights

1. Introduction

Following  independence  in 1957, Ghana  endured  almost four decades of pol-
itical instability including abrogation of constitutional rule. The 1992 Consti-
tution of the Republic  of Ghana  (the Constitution) came  into force in 1993
and  its status as the supreme law  of the land has been  uninterrupted. The
Constitution has  embraced  and  has contributed  to an increased  awareness
of human  rights and democratic  principles which the courts have broadly pro-
tected and  enforced. However,  infringements  of these rights and principles
persist in criminal jury trials.
   The effects of these infringements have long been a source of frustration for
judges, prosecutors, defence lawyers, witnesses, victims and, seemingly, jurors
themselves. For the accused, juries are often more than simply a source of frus-
tration. In many cases juries have, directly or indirectly, resulted in the unjust
