We hope it will be of value in informing you of up-to-date developments in the various resource fields with which the Section is concerned. If it meets with your approval, we will continue it on a regular basis. But we have more than this in mind. Through our newsletter we want to express appreciation to each of you for your interest in the Section, and in turn to inform you of the problems confronting the Section from time to time. This is an age of new ideas and new proposals. Sug- gestions are constantly being made within and outside of the American Bar Association for changes in the-laws, including those relating to min- eral resources. Your Section is a means of keeping you up-to-date on these developments and protecting your interests in the House of Delegates. Carl Illig Section Chairman COAL Significant Decisions A mining contractor is not entitled to share in per- centage depletion allowance when he is paid flat amount per ton of coal produced and must deliver all the coal to the lessor. The right to mine even to exhaustion, without more, does not constitute an economic interest. Paragon Jewel Coal Co. v. Commissioner, 33 U.S. Law Week 4361, decided April 28, 1965. Can an antitrust law violation be based, in part upon allegations that high wages were designed to drive small operators out of business? A decision on this issue is expected soon from the Supreme Court in United Mine Workers of America v. Pennington, Case No. 48, October Term 1964 .71
