Market and Competition Law Review / VOLUME VIII / No. 1 / APRIL 2024

Editorial

Sofia Oliveira Pais
General Editor

The first issue of Volume VIII of the Market and Competition Law
Review gathers several relevant contributions on the legal challenges of a
digital market.
Max Huffman opens the issue delving into the intricate relationship
between Competition Law and Regulation. Huffman analyzes two case
studies - labour and artificial intelligence - highlighting the complemen-
tary roles that Regulation and Competition law may play. The article
clarifies that the choice between competition and regulation depends not
only on the goals pursued by each of them, but also on the temporal and
socio-economic context in which these rules are applied, emphasizing that
regulation will play a key role when the objectives cannot be achieved by
competitive markets.
Still in the context of the interaction between regulation and competi-
tion law, Anna Piszcz examines institutional models that give the compe-
tition authority powers also in the field of sectoral regulation. The paper
compares four models of competition authorities entrusted with addi-
tional sectoral regulation functions: Spanish, Dutch, Estonian and Polish
national competition authorities. Then, it highlights the advantages and
disadvantages of merging authorities and discusses if the ECN Directive
may help to solve some of the shortcomings.
Shifting the focus to digital economy, Friso Bostoen, Lola Montero Santos
and Anouk van der Veer examine the theory of dynamic competition in
generative artificial intelligence. They start from James Bessen's contribu-
tion - The New Goliaths- and discuss under which circumstances unbun-
dling measures are adequate in the contemporary competition context,
