A CRITICAL LEGAL STUDY OF PROPERTY IN LAND

The Critical Legal Studies Movement is perhaps no more than a
passing fashion. But one ought not to assess arguments by guessing
whether they portend the move of the future or a mere footnote for
historians.I
1. Introduction
An eschatology of the present standing of the Critical Legal
Studies Movement whether it is articulated by a sympathetic critic2
or a thrashed thrasher3 does not affect the movement in the hagia-
rchy of jurisprudence. One must wait and see whether the theory
evolves an adequate interpretation of the world which is capable of
shaping a new social reality.
However, in the heated controversy generated by Professor
Unger's address to the Sixth Annual Conference on the movement
held at Harvard Law School in 1982,4 hostile gut reactions
replaced guarded respectful responses; passionate political and
cultural evaluations supplanted balanced intellectual assessment.5
In the words of a reflective legal philosopher:
