1. Introduction:   what  is the innovation   principle?

The  relative newness of the innovation principle, first proposed to the Euro-
pean  Union  (EU)  in 2013,  makes  it poorly understood  and  little known
outside of those working  on innovation  policies. Unlike the precautionary
principle, the innovation principle cannot be found in either primary or sec-
ondary  legislation. Nor has it been formally adopted as part of the Better
Regulation agenda,  the Circular Economy  or the Horizon  2020 regulations.
Unlike most  other principles introduced into the EU treaties, the innovation
principle does not exist in any of the member states' legal orders, and it was
proposed  neither by an EU member  state nor by one of the EU institutions or
agencies. It is, however, gaining ground and is increasingly being referred to in
EU  policy papers (see below). It is important, therefore, that the potential
