PLAY BALL!: SUBSTITUTING CURRENT FEDERAL NON-REGULATION OF FANTASY
SPORTS LEAGUES WITH LIMITED SUPERVISION OF HYPER-COMPETITIVE LEAGUES
     by E rick S. L ee ................................................................................................ . 53
The popularity of Internet-based fantasy sports leagues has taken the game from a
local activity among friends, family members and colleagues, to a social
phenomenon linking players from across the country and beyond. The increased
participation by players of all demographics has led to criticism and commentary
that such games necessitate government regulations to prevent the social ills
traditionally associated with sports wagering. This Article explores the legal aspects
of fantasy sports games, with particular emphasis on current federal gaming law
policy. The history of gambling in America is also traced, in order to provide an
insight into the possible future treatment of these games. While current United
States laws omit fantasy sports from regulations, this Article contends that such
treatment should continue for the majority of such games. However, it is necessary
to supplement the hands off approach with limited supervision and regulation of
high-value, hyper-competitive fantasy sports games in order to protect participants
          in these ventures.
