Whether you practice what many call traditional labor
law or work more in the areas of toxic tort and personal
injury, you simply cannot avoid dealing with issues that
are governed by the Employee Retirement Income Securi-
ty Act-ERISA. COBRA subrogation and preemption of
both state law and section 301 claims give rise to issues
that ERISA touches or regulates.
   This year's National Institute examining ERISA litiga-
tion on an in-depth basis will be held on November 9-11
at the Swissotel in Chicago. The program will present
skilled and experienced litigators from the plaintiff,
union, and management viewpoints. Debate will be lively,
and both fundamentals of litigation and the most recent
developments will be covered. The program builds on the
experience gained from past presentations, and adds a dis-
tinguished U.S. district court judge to offer the judicial
perspective from the trial court bench.


The Section has been well served
this past year by its elected
leader, who gave his best and
devoted untold hours to the suc-
cess of his stewardship. On behalf
of the Section of Labor and
Employment Law, I thank Butch
Powell for a job well done as
Chair. During his tenure as
leader, Section membership con-
tinued to grow, climbing past the  Donald P. MacDonald
20,000 member barrier in July to
assume its place as the fifth largest Section of the ABA. In
addition, registration for Section programs at the Annual
Meeting in Chicago reached a new high, with almost 900
members in attendance.
   Throughout the year there was a significant increase in
activities by our standing committees in publications and
programs. The midwinter meetings of our fourteen stand-
ing committees were attended by over 1,000 lawyers; the
national and regional institutes have attracted over 2,200
participants; and it is anticipated that another 1,000 will
participate in the eleven regional NLRA Basics Programs
currently being presented in cooperation with the NLRB.
It is because of these activities that among the larger Sec-

   The topics include ERISA civil procedure, preemption,
benefit claim litigation, pension and other retirement plan
litigation, COBRA and conversion privilege litigation, dis-
ability and medical plan litigation, retiree health and life
insurance litigation, multi-employer plan litigation, and
benefit litigation arising under the National Labor Rela-
tions Act, the Americans with Disabilities Act, other dis-
crimination laws, and from downsizing. In addition, the
program will include a presentation on special ethical con-
siderations that arise in connection with ERISA litigation.
   In the past, the program has been well received by its
attendees. As one past attendee said, I learned so much, I
raised my rate! Whether you are faced with your first
piece of ERISA litigation or are an experienced practi-
tioner, you cannot afford to miss this program.

Section. Butch was correct when he said that our Section
is alive and well.
   I welcome the new Council members, Don Elisburg
and Howard Shapiro. Each has labored hard and long, Don
most recently as Co-Chair of the OSHA Committee, and
Howard as Co-Chair of the CLE/Institutes and Meetings
Committee. Mike Gottesman of the Georgetown Universi-
ty Law Center will serve as Secretary. Chris Barreca is the
new Chair-Elect, and the Secretary-Elect is Keith Hylton
of Boston University.
   I also welcome the incoming committee co-chairs and
thank the retiring chairs for the outstanding jobs they have
done. The standing committees have been and will contin-
ue to be the center of activity of the Section. Almost 4,000
Section members have taken advantage of the self-nomi-
nation process and are now active in committees. To better
serve these members by improving communication and
disseminating useful information, committees have been
asked to consider publishing their own newsletters. We
continue to remind the 15,000 members who have not self-
nominated for committees that they are not maximizing
the available benefits.
   The Council anticipates greatly expanded activities,
