This volume contains contributions from seasoned and young academics dealing with
the following issues: the developments in Dutch law regarding sexual morality, in
particular pornography; the decision of the Kenyan High Court in relation to the nature
of states' obligations to ensure access to medicines for their people; money laundering
through an attorney's trust account (case note); derogation from constitutional rights
and the African Charter on Human and Peoples' Rights; Uganda's civil courts and the
administration of military justice; criminal liability in cases of dangerous or
irresponsible driving (case note); the potential for the Independent Police Investigative
Directorate to be an effective oversight mechanism to ensure accountability in the South
African Police Service; special interest councillors in the Zimbabwean new constitution;
women's right to reproductive and sexual rights; Nigeria's counter-terrorism measures;
land rights in rural Nigeria; poverty as injustice; the European Union model of regional
integration and its relevancy to the Southern African Development Community; and the
right to basic education in South Africa.
The special issue was edited by Dr Ebenezer Durojaye and Ms Gladys Mirugi-Mukundi of
the Community Law Centre, University of the Western Cape, and focuses on the
application of the African Charter on Human and Peoples' Rights by South African
courts. The theme was inspired, informed and sought to acknowledge the consistent
engagement of the Community Law Centre with the African Commission on Human and
Peoples' Rights. The articles in the special issue were based on papers presented at the
Colloquium on Application of the African Charter on Human and People Rights by
South African Courts, convened by the Community Law Centre. These articles deal with
the following issues: an overview of the challenges of the African human rights system;
developments at the African Court on Human and Peoples' Rights; the right to adequate
