Abstract


This paper aims to address some theoretical and practical issues regarding the organization of the state,
the state apparatus and the identification of European administrative models. It is clear that each state
has its own organization and structure, but some administrative models have common features and that is
why it is important to examine whether these models can be implemented in a standard way, as well-
defined patterns.

Keywords: state, state apparatus, public administration, European administrative
model.

The  organization and  functioning principles of a  society in general and  of state in
particular were major concerns for state philosophy and legal doctrine. Theories on the
organization and functioning of the state were presented since antiquity. All values and
principles promoted by  thinkers throughout time are lost in nothingness if there are no
special mechanisms  of implementation.  This role is played by the state apparatus which
is based on a well-defined structure, namely public administration.
The  state is not an end in itself, but a tool for the organization and the management of
society, in the service of social and political forces that hold the power. Therefore, the
state is an organization of power, by means of which the organization and management
of society is ensured, according to the will and interests of State. The role and functions
of state change in the course of the history; in ancient, feudal societies, the state has
expressed its role and action in accordance with the organization principles and to social
values specific of those societies. In the modem contemporary  democratic  state, where
power  belongs  to people, the  state is used in the interest of the individual, of the
satisfaction of common  good, of citizen rights and liberties.1
Therefore, we  may  speak  about people, individuals exercising the sovereignty of that
State, because they are the purpose and also the means by which  all of these goals may
be implemented.  Without  the individual or by ignoring its interest, the state cannot exist
in its natural form, i.e. the rule of law.
