Teodor SAmbrian The Survival of Roman Law in the dispositions regarding the legal inheritance in Matei Basarab's Code (1652) After presenting the premises of the remanence of Roman Law, seen through the knowledge of Latin and the existence of a juridical academic system during the reign of Matei Basarab, the first part of the article focuses on establishing the quasi identity of the ab intestat heir's class, by presenting, in formal comparison the dispositions included in the mainteined Corpus iuris civilis and in the Indreptarea legii Code, the most important legislative work of the Romanian Medieval Age. in the second part of the article, the author develops arguments supporting the idea that the surviving husband has maintained his quality of legal heir in the Roman Law, even after the reforms applied by Emperor Justinian through the novelles 118 and 127. 1. Premisele receptarii dreptului roman in codul Indreptarea legii Receptarea dreptului roman este legata de cunoasterea limbii latine 'i de existenta unui nv tAmant juridic. Ambele conditii erau ndeplinite in Tara Romneasca la jumatatea secolului al XVTT-lea c'nd, sub domnia lui Matei Basarab, a fost nfiinata coala greaca 'i latin de la Targovi'tel. nitiata de doi carturari greci cu instructie romana i bizantina, Pantelimon Ligaridis i Tgnatie Petri is, scoala si-a desf -urat activitatea intre 1646 'i pan n preajma tipririi fndreptarii legii, fiind organizata dupa sistemul colegiilor iezuite (asa-numitul Ratio adque institutio studiorum Societatis Iesu) : primii trei ani erau consacrati gramaticii latine i grecesti, in timp ce in ultimii doi ani se preda la un nivel superior retorica. Intr-o scrisoare trimisa la Roma la 12 august 1650 Ligaridis afirma categoric ca tine de la sosirea in Tara Romaneasca, de patru ani, catedrele de retoricL ,i de logica in limbile greaca ,i latina la o grupa compusa din 12 tineri apartinnd celor mai marl familii boiere-ti din tara (per spatio di quattro anni m'affaticai insegnando a duodeci giovanni, Rhetorica e Logica 1 v.
