                                 GROW UP ALREADY!
Why is the Supreme Court being Juvenile with Juvenile Justice Reform?

INTRODUCTION

All children are capable of, and worthy of, redemption. No child should ever be sentenced

to die in prison, and every child deserves an opportunity for a second chance, regardless of

their race, socio-economic background, or the crime of which they have been accused. 1

When Henry Montgomery was incarcerated as a teenager in 1963 for the murder of

an East Baton Rouge Parish Sheriff Deputy, President John F. Kennedy was still alive, and

Dr. Martin Luther King Jr. had recently given his I Have a Dream, speech. 2 Mr.

Montgomery's case played a significant role in the resentencing measures of juvenile

offenders sentenced to life without the possibility of parole (LWOP) across the United

States. His 2016 appeal led to him finally being released from prison some five years later.

Although his case ended in victory, it should have never happened. Since Montgomery's

landmark case, others have attempted to appeal their sentences, yet have been unsuccessful

in being resentenced and ultimately released.
