HBCU Student-Athletes File Class Action
Suit Over NCAA Academic Policies

On December 10, 2020, three historically
black colleges and university (HBCU)
student-athletes filed alawsuit in the United
States District Court for the Southern
District of Indiana against the National
CollegiateAthletic Association (NCAA),its
Board ofGovernors, and its Board ofDirec-
tors on behalfofall HBCU student-athletes.
The plaintiffs claim that the NCAAs Aca-
demic Performance Program for regulating
postseason eligibility unfairly discriminates
against Black students at HBCUs.
The plaintiffs argue that the NCAAs
academic policies are in violation of the
District of Columbia Human Rights Act,

which protects against discrimination in
educational institutions, as well as the
NCAAs own Constitution, which states
that the organization shall promote an
atmosphere of respect for and sensitivity
to the dignity of every person.
The plaintiffs allege that these policies
have caused irreparable harm including,
but not limited to, emotional distress, lost
benefits, and loss offuture earning potential.

Concussions and concussion management
in sport have become a polarizing public
health issue. Of the few studies that have
been published that focus on compliance
with the 2010 NCAA concussion man-
agement policy, significant variability has
been shown to exist from one institution
to another. Some institutions have been

found to be in complete compliance, others
are missing key components of the NCAA
protocol, and surprisingly, some institu-
tions lack a concussion management plan
altogether (Baugh, 2016).
A general qualitative design was used to
interview ten senior compliance adminis-
trators and one compliance commissioner
for institutions of higher education that
are members of the NCAA. The primary
objective was to gain valuable insight to
barriers that exist which prevent institu-
tions from full compliance with the 2010
NCAApolicyon concussion management,
