Being able to serve as Acting Chair for nearly six months has given me a unique opportunity to understand more fully the Section's myr- iad of activities, identify cur- rent legislative and interna- Thomas F. Smegal, Jr. tional IP law developments; participate in various ABA, Section and other legal organization seminars and meet personally with many of you regarding your Section involvement and how the Section can im- prove its services in order to continue to meet the needs of its members and the intellectual property law community in general. Thus, we are off and running with a head start for the 1990-91 Association year and I am confident that it will be an innovative and productive year. I have attempted in the last couple of issues of this newsletter to provide information of the activities of the Section Officers and Council in advancing com- mittee resolutions (adopted by the PTC membership at previous annual meetings) through testimony and submission of written statements to Congress, as well as to the PTO and Copyright Office and other gov- ernmental agencies. I will continue this practice dur- ing the next year as to the resolutions favorably acted upon at the 1990 Annual Meeting that are set out beginning on page 11 of this newsletter. The resolu- tions adopted by the membership have already been reviewed by the Section Officers in order to plan the next step toward implementation. Among those resolutions identified for immediate blanket authority (an ABA process whereby Sections are permitted, after certain clearance procedures, to testify/comment to Congress and others in the name of the Section on Section-approved resolutions) are the following: Resolution 101-1 (Patents in Space); Resolutions 102-2, 102-3, 102-5 and 102-6 (Har- monization of Patent Laws and Practice) and New Business Resolution #9 (Rule 56/57 standard of materiality re issue of fraud or inequitable con- duct). New Business Resolution #9 also been identified for submission to the ABA House of Delegates in Feb- ruary to garner the support of a general ABA position on this important subject. Throughout the year, other approved resolutions will be forwarded to appropriate Section committees, other ABA entities, congression- al and agency bodies and national and international organizations as deemed appropriate. The ABA House of Delegates also considered and acted upon a number of important and controversial issues. I'm certain you are aware of these issues as they have been fully commented upon in various ABA com- munications as well as the national press. However, the House of Delegates also adopted a resolution in- creasing Section representation in the House. Effective at the close of the Chicago Annual Meeting, the PTC Section became eligible for a second Section Delegate. I'm happy to report that former Section Chair John K. Uilkema was selected by the Council to serve an initial one-year term that will expire at the close of the 1991 Annual Meeting. The Nominating Committee, when appointed, will solicit your suggestions for candidates for this new position, as well as others scheduled for election at the 1991 Annual Meeting. Joe DeGrandi, who has served as our Section Delegate for nearly two years, was elected in August to serve an additional three-year term. We are fortunate to have two distin- guished past Section chairs ably representing us on the important legal issues that will be debated and acted upon by the Association's House of Delegates at the Midyear and Annual Meetings. The Chicago Annual Meeting was extremely suc- cessful. The educational programs, planned by Jack Goldstein, were timely and well-presented; the social events, conceived and organized by Bob and Diane Newbury, were magnificent; and the often-maligned Windy City weather was delightful.
