ACT OF STATE DOCTRINE
Ninth Circuit finds that district court
violated Act of State Doctrine when it
pursued contempt and discovery proceedings
against bank which had transferred funds to
Philippine government pursuant to judgment

AMERICANS WITH
DISABILITIES ACT
In class action by disabled U.S. citizens
against Norwegian   Cruise Line, Ltd.,
majority of U.S. Supreme Court narrowly
construes clear statement rule as to
applicability of Americans with Disabilities
Act to foreign ships that regularly ply U.S.
ports so that main principles of Act may
apply subject to its own internal limitations
and exceptions as well as to demands of

ANTI-TERRORISM MEASURES
House of Lords unanimously rules that
statute allowing suspected terrorists who are
foreign nationals to be detained indefinitely
without trial is incompatible with European
Convention   On   Human     Rights  as
