Courts should not lose sight of the fact that it is far easier
for a manufacturer to test for defects in his product than
it is for an unskilled consumer to detect defects. Stepping off
from this premise, this article explores the current state of
law involving negligence of design.

The majority opinion of the United States Supreme Court
in what is popularly known as Trainmen v. Virginia holds
that the union has a constitutionally protected right to
recommend specific attorneys to its members. Forty-five
state bar associations supported the stand of Virginia's bar
in opposing the Trainmen. This article is a summary of the
author's remarks made before the American Law Student
Association last year.
