Winter 1984 US nR Section of Inentoa Law an Pr at, Amria Ba soito Restatement of Foreign Relations Law Council Meets With ALI Reporters On December 2, 1983, the Section's Council met with the four Reporters for the American Law In- stitute's Restatement of the Foreign Relations Law of the United States (Revised). Tile Chief Reporter is Louis Henkin of Columbia Law School; the Associ- ate Reporters are Andreas F. Lowenfeld of NYU, Louis B. Sohn of Georgia, and Detlev F. Vagts of Harvard. To date, drafts of the Restatement have been published by the ALI in four installments. Prior to the meeting, Don Wallace Jr. and John B. Houck sent a letter dated November 23, 1983 to the Reporters expressing the Council's concerns as to some of the positions taken in the draft Restatement. The following are highlights of the letter of Messrs. Wallace and Houck. Section members wishing copies of the full letter may obtain them from Professor Wallace by calling 202-828-1369 or Jeffrey Carr at 202-828-1258. 1. Customary International Law § 103. Evidence of International Law states that substantial weight is to be given to international and national judicial or arbitral tribunals, resolutions of international organizations, and writings of ex- perts. The reference to resolutions is controversial and without real precedent. We therefore suggest it be eliminated or at least substantially demoted in importance. More specifically, we do not believe that the proposed treatment of international organization res- olutions can soundly be reconciled with the require- ments of opiniojuris, and we believe it very unwise to try to do so. We do not refer merely to the fact that the constitutions of many international organiza- tions may limit lawmaking decisions, or do not contemplate the free generation of custom. (Continued on p. 9) Spring Section Meeting To Be Held in Philadelphia The Section will hold its Spring Meeting this year in Philadelphia from May 4 to May 6, 1984 at the Bellevue Stratford Hotel. The Spring Meeting will feature a luncheon address by a member of the Reagan Administration and the presentation of the Section's Private International Law Award to the Honorable Richard D. Kearney. The Section's Council will meet in open session on Sunday, May 6, and various Committee meetings are scheduled for Friday, May 4. On Friday evening a dinner will be held at which Richard D. Kearney will receive his Award. A cocktail reception at the Bellevue Strat- ford is scheduled for Saturday evening. Two major educational programs sponsored by the Section will be held at this Spring Meeting in addi- tion to the traditional Section business meetings. These two programs, which will be co-sponsored with bar associations and law schools in the Phila- delphia area, are Common Market Initiatives Af- fecting the U.S. Multinational and U.S. Regulation of American Investment Abroad: The Case of South Africa. There will also be an educational prograr. sponsored by the Committee on International Trade entitled: The Standards Code: The Sleeper of the MTN. The public is invited to all three of thes' educational programs, as well as the Section social events. The schedule for the Spring Meeting may be found ,it page 4 of this issue of the International Law News. Those persons wishing to attend the Spring Meeting should complete the Section Functions Form on page 4 and send the completed Form to Section Head- quarters in Washington, D.C.
