November 1973 Insurance Medicine Rating of Narcotic Addicts Summary. Medical and legal insurance problems, resulting from expert opinion on drug addicts, are described in a survey. Within the area of compulsory Health Insurance, a compulsory financial contribution comes into force, if the drug addiction is to be classified as disease. Legal Old Age and Disablement Insurance concedes after the loss of self-control and for the condition of being unable to stop a legitimate right for rehabilitation and if need be, the allowance of a pension. With respect to the Maintenance of War Victims and the Accident Insurance, a causal relationship between the damaging event and the toxicomania must be probable. In the Private Insurance the norms of the BGB, VVG and AUB are valid, hence the adequacy theory. The Federal Public Relief Law, the Work Furthering Law and the Youth Welfare Law are mentioned in their relation to drug addicts. Proposals regarding the way of proceeding are submitted for expert witnesses. Zusammenfassung. Versicherungsrechtliche und medizinische Fragen, die sich bei der Be- urteilung von Suchtkranken ergeben, werden im Uberblick dargestellt. Im Geltungsbereich der gesetzlichen Krankenversicherung besteht Leistungspflicht, wenn die Sucht als ,,Krank- heit zu klassifizieren ist; in der gesetzlichen Rentenversicherung ist analog, bei ,,Verlust der Selbstkontrolle und ,,Nicht-mehr-aufh6ren-k6nnen, Rechtsanspruch auf Rehabilitation, ggf. auch auf Berentung gegeben. In der Kriegsopferversorgung und der gesetzlichen Unfall- versicherung muB der ursachliche Zusammenhang zwischen dem schidigenden Ereignis und der Sucht ,,wahrscheinlich sein. In der privaten Assekuranz gelten die Normen des BGB, des VVG und der AUB, also die Adiquanztheorie. Das Bundessozialhilfegesetz, das Arbeits- forderungsgesetz und das Jugendwohlfahrtsgesetz werden in ihrer Bedeutung fur Suchtkranke erwahnt. Fur das Vorgehen der Sachverstandigen werden Vorschlige unterbreitet. Key words: Sucht, versicherungsmedizinische Beurteilung - Versicherungsmedizin, Sucht. Das Gros aller Suchtfalle in der Bundesrepublik wird, entgegen spektakularen Berichten der Massenmedien, z. Z. noch von den Alkoholikern gestellt. Ihre The- rapie ist augenblicklich das zentrale sozialmedizinische Problem; erst als zweites kommt die Behandlung der Rauschmittelabhangigen hinzu. Die Erkrankungs- ziffern an Alkoholabusus sind im wesentlichen konstant geblieben. In der BRD haben wir mit 500000 chronischen Alkoholikern zu rechnen. Aus Feldstudien ist * Referat bei der 52.
