The Chairman's Statement I am honored to have the opportunity to serve as Chairman of the bection o P-ublic Utility Law for the coming year and only hope that I can live up to the high standard of performance of your previous Chairmen. It will take assists from your able retiring Chairman Theodore Brophy and Chairman-Elect Horace Moulton, but these, I know, will be readily given. This is the occasion for looking ahead to the coming year rather than for dwelling upon the accomplishments of last year. How- ever, I do commend to the members of the Section the Annual Report for 1966 where you will find not only several articles on timely subjects, but a thumbnail review of important developments in all fields of public utility law prepared by some of the best experts in each field - a truly singular document. I think we all have reason to be pleased with the cohesive spirit displayed by the members of the Section at the annual meeting in Montreal and it augurs well for a year of constructive work on a broader base of participation than ever before. In a subsequent portion of this Newsletter you will find listed the Section committee chairmen who will serve for the coming year. It has been customary for the Chair- man of each committee of the Section to make a report to the Council at its spring and fall meetings, and in addition to supply the editor of the quarterly Utility Sec- tion Newsletter with current information on important developments in their re- spective fields. Accordingly, you may make these gentlemen your point of contact if matters occur to you that you think should be considered by the Section Council. I know that the chairmen would welcome the submission by members of Newsletter items that they think are of unusual interest and might otherwise not be noted. There will without doubt be any number of challenging problems confronting the Council and certain committees of the Section during the coming year. For ex- ample, one such problem will relate to the implementation of the proposal ap- proved this past year by the ABA at the instance of the Public Utility Section, call- ing for federal legislation amending the Federal Declaratory Judgment Act to en- able a party to obtain a declaration as to where jurisdiction lies in a dispute over that question between a federal and state regulatory body. Working with and through the Washington office of the ABA, the Spe- cial Committee to Study Jurisdictional Conflicts in Regulation under Everett I. Willis will endeavor to make progress on already drafted legislative re- medial relief in the next Congress. Another topic on which several members of the Sec- - tion may be working this year is the study of prob- lems related to national strikes in the transportation industries. The House of Delegates authorized ABA President Marden to appoint a committee of not to exceed nine members to make such a study and a re- quest has been directed to Mr. Marden for appoint- ment to the committee of two representatives from our Section, but as yet we do not know whether this request will be honored. Another member of the Section has been asked to follow all developments growing out of the work of the Standing Committee Gregory S.
