The news is prepared for you by the hard-working chairmen of the various committees of the Section, and is put together by our very fine secretary, Francis X. Welch, who is known to all as the editor of the Public Utilities Fortnightly. We who are practicing in the field owe them all a debt of thanks. Our Section of the American Bar Association covers the entire field of private pub- lic service and should be the finest medium for the timely and forceful expression of the views of those who practice in this area of the law. Your Council is charged with the duty of seeking ways in which to accomplish this end. The members of the Section have, and should have, many strong arguments among themselves on mat- ters which affect free competition between branches of the private utility industry - such as taxation, subsidies, and regulation. These we should bring out and air, in the interest of a better understanding of one another's problems. Then, there are problems which affect all branches of the private utility industry with more or less equal force, and on which the membership may often be united. I would like to cite three of these. The members of the Section undoubtedly stand for administrative process which will accomplish the ends of public service in the most expeditious and reasonable fashion and oppose legislation which would judicialize, and unduly complicate and delay. I realize that the ABA officially sponsors and supports the proposed Admin- istrative Code, but I personally oppose this legislation on the ground that it would unduly 'udicialize, delay, and complicate the administrative process. I also be- lieve that the majority of the Section likewise personally opposes it and that our Section should work, as best it may, to have the association reverse its stand and withdraw its support. I believe that the members of the Section consider the Administrative Conference to be an administrative device of the highest importance, and support both its work and legislation which would place it upon a continuing basis. I believe the Section should advance these ends to the best of its ability. I believe that our membership stands for the rendition of service by private utili- ties, as distinguished from public agencies, and that we oppose taxation and other substantive and procedural legislation which would discriminate in favor of public agencies. Your views on these or any other subjects will be welcomed and will be placed be- fore the Council at its November meeting. - C. William Cooper, Chairman ABA Section of Public Utility Law
