i       Introduction
The Ruiz Zambrano judgment of the European Court of Justice (E cJ), delivered
on 8 March 2011, is certainly one of the most controversial decisions of the
last decade.1 All intervening Member States and the European Commission
unequivocally argued that the issue at stake, i.e. the possibility for a third coun-
try national parent of a minor EU citizen to obtain a residence right, clearly fell
outside the scope of application of EU law in the absence of any cross-border
element.2 The Court relied on Article 20 TFEU and the fundamental status of
