In the spring of 1994 Criminal Law Forum published a special double
issue on the creation, mission, and likely troubles of the International
Tribunal for the Former Yugoslavia.1 Though we did not set out to
follow up the achievements of the Tribunal that is precisely what has
happened in the current issue. At the moment, two closely related
matters dominate the international criminal law agenda: bringing to
justice the perpetrators of grave violations of international humanitarian
law in the former Yugoslavia and Rwanda and bringing to fruition the
work of the International Law Commission on the establishment of a
