IMPORTANT LAND DECISIONS.
In the timber culture application of
James Hair from Kirwin, Kansas, Secre-
tary Noble, on May 6, 1889, states that the
rulings heretofore have been too technical
and illiberal or too broad and subversive
of the law, which provides that only
 prairie or other land naturally devoid of
timber, shall be included in a timber cul-
ture application. He says that the law
means practically devoid of timber, that is,
where only a few trees are found on a sec-
tion, especially along ravines or river bot-
toms, timber culture entries should be al-
lowed. Where the surveyor's plat and field
notes show the land to be covered with
timber, a hearing should be had to deter-
mine the character of the land before en-
try is permitted.
It is an old rule of the Land Depart-
ment that a single woman who having
filed a pre-emption declaratory statement,
forfeits her rights as a pre-emptor by mar-
riage before she completes her final entry
and pays the purchase money. In case
of Melissa J. Cunningham, born Glover,
Valentine district, Nebraska, Assistant
Secretary Chandler, on April 25, 1889, de-
cided that Mrs. Cunningham, having been
misled by the erroneous advice of the reg-
ister and receiver, should not lose her
land, notwithstanding she married prior
to final entry. In this same case it was
ruled that a pre-emptor who did not sign
his own declaratory statement did not
thereby forfeit his right, as the declaratory
statement is merely a notice to the public.
