Canadian Human Rights Benefit Regulations

His Excellency the Governor General in Council, on the
recommendation of the Minister of Justice, pursuant to section
18* of the Canadian Human Rights Act, is pleased hereby to
make the annexed Canadian Human Rights Pension and In-
surance Regulations, effective March 1, 1980.
CANADIAN HUMAN RIGHTS PENSION AND
INSURANCE REGULATIONS
Short Title
1         These Regulations may be cited as the Canadian
Human Rights Benefit Regulations.

Interpretation

2(1)

In these Regulations,

Act means the Canadian Human Rights Act; (Loi)
actuarial basis means the basis of the assumptions and
methods used by a Fellow of the Canadian Institute of Ac-
tuaries to establish the costs of benefits under a benefit plan,
taking into consideration the contingencies of human life,
such as death, accident, sickness or disease; (base ac-
tuarielle)
benefit, in respect of a benefit plan, includes
(a)  an aggregate amount or an annual, a monthly or other
periodic amount or the accrual of such amounts to
which an employee or his beneficiary, survivor,
spouse, child or dependant is or may become entitled
under the plan on superannuation, retirement, ter-
mination of employment, disability, accident, sickness
or death,
(b)  any amount to which one of the persons referred to in
paragraph (a) is or may become entitled under the plan
for medical, hospital, nursing, drug or dental expenses
or other similar expenses, and
(c)  any amount to which one of the persons referred to in
paragraph (a) is or may become entitled under the plan
on superannuation, retirement or termination of
employment or to which any person is or may become
entitled under the plan on the death of another person;
(prestation)
benefit plan means an insurance plan or a pension plan,
whether or not the terms and conditions thereof have been set

I'article 18* de la Loi canadienne sur les droits de la personne,
it plaft A Son Excellence le Gouverneur general en conseil
d'etablir, a compter du 1er mars 1980, le Reglement
concernant I'application de la Loi canadienne sur les droits de
la personne aux regimes de retraite et d'assurance, ci-apres.

Dans le present reglement,

age normal de la retraite, pour un emploi ou un secteur
professionnel, designe I'age maximal dont it est question A
l'alinea 14b) de la Loi, ou I'Age vise A l'alinea 14c) de la Loi;
(normal age'of retirement)
Age normal ouvrant droit A la pension, dans le cadre d'un
regime de retraite, designe la premiere date specifiee A la-
quelle un employe peut prendre sa retraite et toucher les
prestations auxquelles it aurait normalement droit en vertu du
regime, sans rajustement a cause d'une retraite anticipee, que
cette date soit celle d'un anniversaire de naissance ou le der-
nier jour d'une periode d'emploi; (normal pensionable age)
base actuarielle designe la base des hypotheses et des
methodes qu'utilisent les membres de I'Institut canadien des
actuaires pour etablir le coOt des prestations aux termes d'un
regime de prestations, compte tenu des facteurs humains im-
ponderables tels que le deces, les accidents ou la maladie;
(actuarial basis)
conjoint, d'un employe participant a un regime de
prestations a le sens que lui prete le regime et comprend le
conjoint de fait, au sens du regime, si,
(a)  pendant la periode minimale etablie selon le
paragraphe (2),
(i) cette personne a habite en permanence avec
l'employA et qu'en raison de son mariage
precedent ou de celui de l'employe, elle ne pouvait
legalement 1'epouser, et
