BANKRUPTCY: STUDENT LOANS: EFFECT OF DISCHARGE

in Bankruptcy. No. 172-154. Order. September 23, 1977. On May 20, 1977,
Mills filed a voluntary petition in bankruptcy. He listed $8,400 owed to the
Medical College of Georgia on student loans. The Board of Regents of the
University System of Georgia, for and on behalf of the Medical College of
Georgia, filed its complaint in a federal district court, seeking to have
this debt declared not provable and therefore not dischargeable under Sec-
tion 17 of the Bankruptcy Act. The court, in ordering that the obligation
of the bankrupt to the Medical College be declared not provable and not
affected by any Order of Discharge, said:
At the time the bankruptcy petition was filed, no payment
by Mills had yet come due. Mills had not yet defaulted, neither
had he selected a site where he would practice nor was he re-
quired at this time to make such a selection. The conditions
and contingencies of the notes beyond the control nf the cred-
itor make the amount of the liability impossible to ascertain.
What will become due under these notes is still to be determined
by the future acts of the bankrupt.
