handle is hein.journals/brexhndk1 and id is 1 raw text is: OCTOBER, 1966 APPOINTMENT OF FEDERAL AND STATE JUDGES The House of Delegates of the American Bar Association approved two resolutions in 1966 generally urging state and local bar associations to seek commitments from candidates for the offices of United States senator and state governor. Such commitments would be designed to insure that only qualified law- yers would occupy judicial offices in our federal courts and in the courts of those states where a relatively unrestricted appointive procedure is extant. These resolutions are reproduced in this Bar Key announcement. The assistance of state and local associations is earnestly requested in achieving the objectives described in the resolutions. RESOLUTION CONCERNING APPOINTMENT OF FEDERAL JUDGES WHEREAS, a qualified and independent judiciary is indispensable to the welfare of the Country and the protection of the freedom and rights of every individual; and WHEREAS, the official position of the American Bar Association is that judges should be selected on the basis of qualifications only and without regard to partisan considerations; and WHEREAS, by reason of their training and experience and their daily contacts with others of their profession, lawyers are especially qualified to investigate and report upon the character, temperament, professional competency and other qualifications of members of the judiciary and fellow members of the Bar under consideration for nomination as judges; and WHEREAS, the Standing Committee on Federal Judiciary of the American Bar Association is com- posed of leading members of the Bar from each of the eleven Federal judicial circuits; and WHEREAS, at the instance of the President of the United States, through the Attorney General, the Standing Committee on Federal Judiciary of the American Bar Association investigates and reports to the Attorney General regarding the qualifications of judges and lawyers under consideration for nomination as judges in the Federal courts; and likewise, at the request of the Senate Committee on the Judiciary, re- ports to that Committee; and WHEREAS, there will be 35 United States Senators elected this year; BE IT RESOLVED, that all State and local Bar Associations are urged to initiate and actively pur- sue a program for obtaining commitments from the Senators in their respective states, and more especially at this particular time from all candidates for the United States Senate, in which they agree to cooperate in the program whereby the President of the United States, through the Attorney General, refers to the Standing Committee on Federal Judiciary of the American Bar Association for investigation and report, persons under consideration for nomination as judges in the Federal courts, and to withold support from any person reported by the Committee to be not qualified for such nomination.
