MR:  You argue that lawyers are an unhappy lot, plagued
by alcohol and drug addictions, divorce, depression and
suicide, not to mention their 'justifiable paranoia' that
people are out to get them and the public regards them
with disdain. You note the unhappiness begins in law
school. Do you wonder why so many Americans apply to
and attend law school?

JS/RD:  Probably because of TV  shows  and popular
novels glamorizing lawyers or making law school sound
like a cool, intellectual version of Marine boot camp,
something that will make you tougher and stronger. Many
students with broad humanities backgrounds come to law
school because they realize that further training in the
fields they really love, such as literature or history, will not
offer them a way to make a living. And there's that old


parental mantra: I hope my son or daughter grows up to
be a professional. What all the studies show is that within
a few months of entering law school, many students realize
they have made a bad mistake. Law school is not so much
intellectually stimulating as boring, and the rewards that
await those who stick it out are not what they are cracked
up to be.

MR:  What  do you teach, and do you teach differently
from standard law school instruction to allow for a more
humanistic classroom experience?

JS: We  teach courses in race and civil rights. Richard,
separately, teaches civil procedure. We try in all our
courses to impart a broad vision of law and its possibilities
and encourage students to consider alternative law careers,
such as teaching, judicial clerkships, public interest law,
and  law reform. We  teach interdisciplinary insights-
history, social science, even economics, to drive home the
idea of law as a broad humanistic discipline, and constantly
challenge our students to consider the social, non-doctrinal
consequences of cases and statutes, as well as the lawyer's
role in ushering in change and reform.

MR:  Formalism, as you define it, is a habit of mind and a
type of social organization that attempts perversely to
narrow one's focus beyond that which a situation requires
