RESUMO:   Nos feitos de natureza penal, e comum que a autoridade policial venha
a se deparar com  vestigios biol6gicos capazes de apontar a autoria do delito.
A titulo exemplificativo, podem-se citar semen em crimes  sexuais, celulas do
agressor sob as unhas  da vitima ou mesmo   sangue  do delinquente ao tentar
se evadir pela vidraga de uma  moradia. Contudo,  diante de um  alargamento
interpretativo, extremado do principio da presuncao de  inocencia, he grande
dificuldade em se proceder ao cotejo entre eventual material genetico encontrado
e a pessoa do  investigado, tudo sob a justificativa da protecso que the e dada
em  nao produzir prova contra si, revestindo-o com um escudo de impunidade.
Em  tal cenerio, busca-se estabelecer diferenciacao entre a produso de prova
autoincriminat6ria e a tolerancia de prova, esta Oltima, entende-se, contornada
pelos limites constitucionais.

ABSTRACT:   In criminal proceedings, it is common for the police authority to come
across biological traces that may point to the offender. As an example, one can
mention semen  in sexual crimes, aggressor cells under the victim's nails or even
the offender's blood when trying to escape through a window. However, in view
of an interpretative widening and exacerbation of the principle of presumption of
innocence, there is great difficulty in comparing any genetic material found and
the suspect, due to the protection given to one so as not to produce evidence
against oneself, which covers one with an impunity shield. In such a scenario, we
seek to distinguish the production of self-incriminating evidence and the tolerance
of evidence, the latter being understood as circumvented by constitutional limits.
