Para isso, são descritos os referidos direitos e garantias fundamentais, definindo ainda o mandado de busca e apreensão e o mandado de busca e apreensão coletivo. Discute-se, por fim, o crime organizado e seu combate, mencionando a recente intervenção federal decretada no Rio de Janeiro e o suposto conflito entre direitos individuais e a segurança pública. Perquiriu-se, como escopo, uma conclusão a respeito da constitucionalidade do mandado de busca e apreensão genérico, ante o embate aparente entre direitos individuais e coletivos, entendendo-se que o direito à inviolabilidade do domicílio não é absoluto. Abstract: The general objective of this article is to discuss the constitutional inviolability of the domicile, as well as of other fundamental rights and guarantees set out in the Constitution of the Federative Republic of Brazil. To this end, the fundamental rights and guarantees are described, and individual and collective search warrants are defined. Finally, organized crime and the fight against it are discussed, mentioning the recent federal intervention carried out in Rio de Janeiro and the supposed conflict between individual rights and public safety. The goal is to reach a conclusion regarding the constitutionality of collective search warrants, in light of the apparent clash between individual and collective rights.
