For anyone that has paid attention to food safety issues over the past ten years, these examples represent notori- ous failures in protecting American consumers. In 2009, an outbreak of Salmonella affected 714 people across forty-six states stemming from con- taminated peanut butter.' The year 2011 saw the deadliest outbreak of Listeria in a decade with 147 reported cases, 143 hospitalizations, and thirty-three deaths stemming from cantaloupes grown at Jensen Farms in *J.D.
