The Acting Secretary of the Treasury, in a corhmuni-
cation dated December 17, 1941, has informed the Patent
Office as follows:
It is understood that a question has been raised by
you as to whether Executive Order No. 8389, as anended,
and the Regulations issued pursuant thereto, still permit
the filing and prosecuting of applications for patents by.
and the issuance of Letters Patent to, nationals of coun-
tries with which the United States is now at war.
You are inforlned that with respect to Japan, and
nationals thereof, all general and specific licenses were
revoked on December 7, 1941, by Public Circular No. 8,
a copy of which is cnClosed. However, on December 15,
1941, the Treasury Department issued General License
No. GSA unblocking, subject to the provisions of para-
graph  two of that general license, tile aCcounts of
Japanese nationals who have resided continuously within
the continental United States sicCe June 17, 1940, and
the accounts of business enterprises within the United
States owned or controlled by such Japanese nationals.
There ale enclosed for your iuforlation a copy of General
License No. 68A and the lPress Release issued on December
15, 1941.   This Department will be glad to keep you
advised of any further action taken with respect to
Japanese nationals which may be of interest to your
Office. In the leantilne, of course, this Department will
give consideration to any specific applications for liienses
which may be filed by nationals o    Japan with respect
to patent matters.
With. respect to nationals of Germany and Italy and
other countries which may be at war with the United
States. the Departlment ha:1s not taken the sanme action
as was taken with respect to Japanese nationals. Gen-
cral Licenses No. 72 and No. 5, issued under the Executive
Order, are still outstanding and in effect with respect
to Germaly, Italy and such other countries. Therefore,
in so far as Executive Order No. 8389. as amended, is
concerned, these general licenses still authorize. subject

to the terms thereof, the filing and prosecution In the
United States Patent Office of applications for patents
and the receipt of Letters Patent by nationals of Ger-
many, Italy and such other countries as may be at war
with the United States, and the payment of fees to
the Patent Office by such nationals.

Notice of Cancellation

take notice:
An application for cancellation having been filed in
this Office by Philip de Journo, 124 Peachtree Memorial
Drive, Atlanta, Ga., to effect the cancellation of trade-
mark registration of The Pogo Company, 35-37 East
10th St.. New York, N. Y., No. 176,107, dated November
20, 1923 and the notice of such proceeding sent by
registered mil to the said The Pogo Company at the
said address having been returned by the post office
undeliverable, notice is hereby given that unless said

shall enter an appearance therein within thirty days
from the first publication of this order the cancellation
will be proceeded with as in the case of default. This
